Ticket Purchase Policy
TEAM GB LIVE TICKET PURCHASE POLICY
This Team GB Live Ticket Purchase Policy and the Tokyo 2020 Ticket Terms and Conditions (together the "Terms and Conditions") set out the basis on which We offer Tickets for purchase for the Tokyo 2020 Olympic Games.
Please note that any breach of the Terms and Conditions (including without limitation, the prohibitions on resale, transfer and commercial use) will result in the cancellation of the Tickets.
1.1. In these Terms, the following words and phrases have the following meanings:
Attendee: each person who ultimately receives the benefit of the Ticket and/or attends a Session.
BOA: the British Olympic Association.
Confirmation: an email communication We send to You accepting, confirming and detailing Your Ticket purchase.
Contract: the Terms and Conditions, the Confirmation and the Venue Terms.
Games: means the XXXII Olympiad TOKYO 2020, in the City of Tokyo, where Sessions will be hosted in the period from 24 July 2020 to 9 August 2020.
IOC: the International Olympic Committee.
Session: means the period/time frame for which a Ticket issued by TOKYO 2020 is valid for access to an event or group of events of the Games (including, without limitation, sports events and opening and closing ceremonies.)
Team GB Live: Sports Travel & Hospitality Group Limited trading as Team GB Live of Level 2 Avalon House, 72 Lower Mortlake Road, Richmond-upon-Thames, Middlesex, TW9 2JY, Company No: 08971103.
Terms: this Team GB Live Ticket Purchase Policy.
Ticket(s): means evidence of a license issued by TOKYO 2020 which entitles the holder to be admitted to a Session, which may be in electronic form or may be a conventional, printed ticket of admission.
TOKYO 2020: the Tokyo Organising Committee for the 2020 Olympic and Paralympic Games.
Tokyo 2020 Ticket Terms and Conditions: means the terms and conditions of the contract for the sale of each Ticket to be entered between each purchaser of a Ticket and TOKYO 2020, accessible here https://ticket.tokyo2020.org/Home/TicketTerm?culture=en-us
Venue: the venues at which the Sessions are to take place.
Venue Terms: the terms that apply to Attendees whilst at the Venue.
We, Us: Team GB Live.
Working Day: a day other than a Saturday, Sunday or Bank Holiday when banks in London are open for business.
You, Your: the person purchasing the Ticket(s) and to which the Ticket(s) is supplied.
- KEY TERMS
2.1. We recommend that You read the Terms and Conditions carefully and print/keep a copy for Your records.
2.2. The Contract is between Us and You. We will only discuss the Contract with You, except where We have (at our sole discretion) agreed with You to discuss the Contract with a named third party and have received a written authorisation from You confirming the named third party's details.
2.3. We reserve the right to alter the Terms and Conditions from time to time in accordance with changes to legislation and regulations and as required by the BOA, the IOC and/or TOKYO 2020.
- HOW TO PURCHASE TICKET(S)
3.1. To purchase a Ticket from Us You must be 18 or over, have a valid credit/debit card issued in Your name and have a residential address in Great Britain and Northern Ireland (including the Channel Islands and the Isle of Man) or any member state of the European Union or European Economic Area. Any purchase of Ticket(s) that does not comply with the Terms and Conditions will be cancelled.
3.2. To purchase a Ticket, You must create a Team GB Live account and complete all requested information truthfully and accurately. Instructions to create an account are detailed on the Website.
3.3. If You choose, or You are provided with, a user identification code, password or any other piece of information as part of our security procedures, You must treat such information as confidential. You must not disclose it to any third party.
3.4. By purchasing a Ticket from Us through Your Team GB Live account, You acknowledge that You have read, understood and agreed to be bound by the Terms and Conditions. If You do not agree to the Terms and Conditions, or if You cannot comply with any of the Terms and Conditions then You must not make a purchase of a Ticket.
3.5. We do not accept Ticket purchases that are conditional on any special requests You have made.
3.6. You agree not to obtain or attempt to obtain any Ticket through unauthorised use of any robot, spider or other automated device or any other illegal or unauthorised activity. We reserve the right to cancel any transaction which We reasonably suspect to have been made in breach of the Terms and Conditions without any notice to You and any and all Tickets purchased as part of such transaction or relating to a Team GB Live account will be cancelled.
3.8. If You know or suspect that anyone other than You knows your user identification code or password, You must promptly notify Us. You shall be liable for all Ticket purchases placed through Your Team GB Live account.
- PAYMENT AND FOREIGN EXCHANGE
4.1. All prices for Tickets are displayed on the Website as follows:
4.1.1. the face value of the Ticket in pounds sterling (GBP);
4.1.2. the face value of the Ticket in Japanese Yen (JPY);
4.1.3. the Ticket handling fee per Ticket (GBP); and
4.1.4. the exchange rate to be applied to the Ticket.
- CONFIRMED TICKET PURCHASES
5.1. All Ticket purchases are subject to availability and a binding commitment to provide the Ticket shall not come into existence unless and until We dispatch a Ticket Confirmation to You.
5.2. If You do not receive a Ticket Confirmation after submitting payment information, or if You experience an error message or service interruption after submitting Your payment information, it is Your responsibility to confirm via Your Team GB Live account whether or not You have successfully purchased a Ticket. We will not be responsible for any costs or losses You incur if You assume that You have purchased a Ticket without receiving a Ticket Confirmation.
5.3. Purchases will be subject to a non-refundable delivery fee. Delivery to an address outside of the United Kingdom will be subject to an additional delivery fee.
5.4. Whilst We try to ensure that all prices on our Website are accurate, errors may occur. If We discover an error in the price of any Ticket You have purchased, We will inform You as soon as possible and give You the option of:
5.4.1. confirming the Ticket purchase at the correct price, in which case We will credit or debit Your account as applicable; or
5.4.2. cancelling Your Ticket purchase, in which case You will receive a full refund from Us.
5.5. In the event We discover an error in the price of any Ticket You have purchased but We are unable to get in contact with You in accordance with clause 5.4 above, You agree that We may treat Your Ticket purchase as cancelled.
5.6. We reserve the right to cancel Contracts which We reasonably suspect to have been made fraudulently.
5.7. TOKYO 2020 reserves the right to determine at its sole discretion, the total number of Tickets to be distributed to the public, and TOKYO 2020 may increase or decrease the number of Tickets at any time. As a result, We reserve the right to finish or resume the sales of Tickets. For the avoidance of doubt, notwithstanding the increase or decrease of the total number of Tickets, or end or restart of the sales of Tickets, no purchase of Tickets may be changed or cancelled in any case, and any Tickets already purchased may not be changed, cancelled, exchanged or refunded.
- TICKET REQUIREMENTS
6.1. All Tickets are supplied in accordance with the Tokyo 2020 Ticket Terms and Conditions as amended from time to time.
6.2. You are required to agree to be bound and comply with the Tokyo 2020 Ticket Terms and Conditions. You promise that You will inform all Attendees of the Tokyo 2020 Ticket Terms and Conditions and procure their acceptance of the Terms and Conditions. You will be responsible for all Attendees compliance with the Terms and Conditions.
6.3. You acknowledge and agree that the Tickets We provide to You:
6.3.1. are for Sessions and not individual events;
6.3.2. are for personal, non-commercial use only;
6.3.3. are not for resale or transfer and cannot be used by, sold, given or transferred to any third party, including without limitation any:
188.8.131.52. sponsors/corporate partners;
184.108.40.206. travel partners, travel suppliers or supporter clubs;
220.127.116.11. any promotional activity; and/or
18.104.22.168. secondary ticketing websites or online marketplaces;
6.3.4. must not be used as competition prizes, for charity donations (including auctions) or raffles;
6.3.5. must not be used for any internal or external promotions;
6.3.6. must not be combined with any hospitality services, travel package, entertainment, food, drink and/or privileged access to a facility supplying hospitality services whether inside or outside the relevant Venue, except IOC/TOKYO 2020 official hospitality products and services (to the extent this is permitted by those products and services' terms and conditions) except with our prior written consent;
6.3.7. shall not be replaced if lost, stolen or damaged; and
6.3.8. remain the property of TOKYO 2020 and are a personal revocable licence which may be withdrawn, and admission refused at any time.
6.4. You acknowledge and agree that You are prohibited from any display of trademarks, trade names, logos, emblems or other distinctive signs (other than Games-related marks displayed by authorised persons, including only Games partners marks).
6.5. We reserve the right to cancel Your Ticket purchase where We believe, in our sole discretion, that You are in breach of clauses 6.3 and 6.4.
6.6. We shall not be responsible to You or any Attendees if a Ticket is cancelled or an Attendee is refused entry to, or ejected from, a Venue as a result of breaching the Contract.
6.7. Whilst You will be able to purchase a Ticket in relation to a Session, You will not be allocated a specific seat at the Session(s) until Your Ticket(s) are dispatched.
- TICKET ALLOCATION
7.1. Where available, Venue maps showing categories and/or locations of Tickets are for information purposes only and made available as a guide. The guides are not to scale and are an approximation of where You may be seated in a Venue. TOKYO 2020 is responsible for all seating allocations and categorisations and reserves the right to re-categorise, move or reallocate categories and locations, and change Venues at its sole discretion. We may not be informed of such reorganisations or re-categorisations. You have a right only to a seat of a value corresponding to that stated on Your Ticket. We, the Venue or TOKYO 2020 reserve the right to provide alternative seats (whether before or during the Session) to those initially allocated to You or specified on the Tickets.
7.2. If You are booking as a group, please note that it is not guaranteed that Your group will all be able to sit together in the Venue.
7.3. Please note that Session start and end times shown on the Website are indicative and may change, all start times are subject to confirmation and may change for reasons outside of our control.
- ATTENDEE INFORMATION
You are required to keep records documenting the names of all the Attendees allocated to each Ticket, against the row and seat number. You may be required to provide individual Attendee information prior to the dispatch of Tickets. You will be responsible for collecting the information with all necessary consents to transfer such information to Us.
- SPECIAL MOBILITY, ACCESSIBLE & DISABLED TICKETS
If You require special mobility or accessible/disabled Tickets You must inform Us prior to making Your Ticket purchase. Please note that accessible/disabled Tickets are very limited and special mobility arrangements at each Venue are under the control of Tokyo 2020 over whom We have no control. We will make a request on Your behalf to Tokyo 2020 to obtain tickets that meet your accessible requirements. Subject to availability, We will confirm to You if We have been able to secure Accessible seating at which point You will be required to complete the purchase. If You purchase tickets via the Team GB Live website and this process is not followed, You will have general admission tickets.
- TICKET DELIVERY
10.1. We will distribute Your Tickets to You in a manner that We deem most appropriate. We will inform You which method of distribution We intend to use but reserve the right to amend this at any time. Once distributed, Tickets are Your responsibility and cannot be replaced.
10.2. Please allow as much time as possible for Your Tickets to arrive. If Your Tickets have not arrived five days before You travel, please contact Us.
10.3. When You receive Your Tickets, please keep them in a safe place and check that they are correct. You need to report any issues to Us within three Working Days of receipt. We will not be responsible for any Tickets that are lost or stolen.
10.4. We reserve the right to make Tickets available for collection by You at a location We deem appropriate. We will notify You by telephone or email of the arrangements for collection (using the details provided by You at the time of ordering) if this becomes necessary. You will be required to present identification to collect the Tickets.
- TICKET RESTRICTIONS
11.1. When purchasing Tickets from Us, You are limited to a maximum number of Tickets per Team GB Live account. This policy is in effect to discourage unfair Ticket buying practices. Tickets may be restricted to a maximum number per person, per credit card and, for some Sessions, a restriction may apply per household. We will notify You if You reach this limit. We reserve the right to cancel Tickets purchased in excess of this number without prior notice and at our sole discretion.
11.2. Tickets may be sold subject to certain restrictions on entry or use, such as restricted, obstructed or side view or a minimum age for entry. Any such restriction shall be displayed on the Website or otherwise notified to You. It is Your responsibility to ensure that You read all notifications displayed on our Website.
11.3. Nothing in the Terms and Conditions permit You to use Tickets You have purchased to commercially associate yourself with Us or TOKYO 2020 and/or the Games or otherwise use any of the imagery or trademarks We use.
- YOUR OBLIGATIONS
12.1. You will ensure the proper conduct of the Attendees at the Sessions and in the Venue(s).
12.2. You will ensure that the Attendees are aware of and comply with the Venue's and Tokyo 2020's instructions and the Terms and Conditions.
12.3. You will promptly supply all information requested by Us about You and the Attendees.
- CANCELLATION, CHANGES AND RESCHEDULING
13.1. TOKYO 2020 may alter or vary the competition schedule at its sole discretion. It is Your responsibility to ascertain whether a Session has been cancelled, changed or rescheduled and the date and time of any rearranged Session. We do not guarantee that You will be informed of such cancellation, change or reschedule before the date of the Session.
13.2. Tickets are sold subject to TOKYO 2020's right to alter or vary the competition schedule due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange Tickets.
- ADMISSION AND ATTENDANCE AT THE VENUE
14.1. The Venue reserves the right to refuse admission should You breach any of the terms of the Contract (including the Tokyo 2020 Ticket Terms and Conditions) and/or the Venue Terms.
14.2. Entrance to the Venue will be refused at the Venue operators sole discretion. We shall not be liable to You if You are refused entry for any reason.
14.3. You acknowledge that You are individually responsible for Your own property and there is no storage available at the Venue.
14.4. It is Your responsibility to check the Venue Terms and make Yourself aware of the list of prohibited items.
14.5. You will be obliged, upon request, to give an explanation as to how, from whom and from where Your Ticket has been obtained.
14.6. Any breach of these Terms may, and even if the Attendee did not have notice of these Terms or the breach, result in refusal of entry, eviction/expulsion from the Venue, cancellation of the Ticket and no refund of the purchase price of the Ticket. All Tickets remain the property of TOKYO 2020. In the event of a breach of any of these Terms, Tickets will, upon request of TOKYO 2020, be delivered up to TOKYO 2020. Such actions are without prejudice to other remedies which may include a fine and/or legal action.
14.7. Entry to the Venue will only be authorised upon presentation of a valid Ticket (one Ticket will be required for each Attendee, regardless of age) and, upon request, proof of identity with valid photograph and signature. You must comply with the safety and security protocols in place at the Venue.
14.8. In attending a Session You acknowledge that Your presence and/or movement in and around the Venue is at Your own risk and that to the maximum extent permitted by law, We, TOKYO 2020, or any other relevant body cannot be held liable for any loss and/or harm, including but not limited to bodily or mental harm, personal property damage or loss, or any other loss and/or harm arising from and/or occurring during attendance at the Venue.
15.1. Cancellation: If a Session is cancelled (and not rescheduled), the Tokyo 2020 Ticket Terms and Conditions will apply in respect of Your Ticket for such a cancelled Session. We shall use our reasonable endeavours to recover any sums for the Ticket under the Tokyo 2020 Ticket Terms and Conditions on Your behalf, delivery and handling charges will not be refunded.
15.2. Reschedued, delayed or interrupted: If a Session is rescheduled, delayed or interrupted (and not cancelled) the Tokyo 2020 Ticket Terms and Conditions will govern the use of Your Ticket. We shall have no liability to You or any Attendee in respect of such Ticket.
15.3. These Terms do not and shall not affect Your statutory rights as a consumer.
15.4. We regret that, unless paragraphs 15.1 or 15.2 apply, Tickets cannot be exchanged or refunded after purchase.
- OUR LIABILITY TO YOU
16.1. Personal arrangements including travel, accommodation or hospitality relating to the Session which have been arranged by You are at Your own risk. Neither We nor the BOA and/or TOKYO 2020 shall be liable to You for any loss of enjoyment or wasted expenditure.
16.2. Unless otherwise stated in this clause 16, our liability to You in connection with the Contract (including, but not limited to, for any cancellation, rescheduling or material change to the Session) shall be limited to the price paid by You for the Ticket.
16.3. Our liability to You shall be reduced by the corresponding amount that You receive directly from TOKYO 2020 in relation to Your Tickets. In no circumstances shall You be entitled to claim for the same loss suffered in respect of a loss arising under this Contract if it has already claimed for and recovered from TOKYO 2020.
16.4. We shall not be liable for any loss, injury or damage to any person (including You) or property howsoever caused: (a) in any circumstances where there is no breach of a legal duty of care owed by Us; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by You of any of the terms of the Contract or Your negligence.
16.5. Nothing in these Terms and Conditions seeks to exclude or limit our liability for death or personal injury caused by our negligence, fraud or other type of liability which cannot by law be excluded or limited.
16.6. You will indemnify and hold Us, the BOA and TOKYO 2020, or any other relevant body harmless from and against all damages and liabilities suffered or incurred in connection with, resulting from, or arising out of, a breach by You or Your Attendees of the Contract.
17.1. We may terminate the Contract with immediate effect if:
17.1.1. You fail to make a payment in accordance with clause 3 of these Terms;
17.1.2. in our judgment, there is a risk that You or any of Your Attendees has breached or will breach clauses 6 or 10 of these Terms;
17.1.3. You have breached any provision of the Terms and Conditions; or
17.1.4. You become subject to an Insolvency Event.
17.2. If We terminate the Contract pursuant to clause 17.1 of these Terms, We may additionally:
17.2.1. cancel Your Ticket and reject any further orders; and
17.2.2. pursue any other remedies, including claiming damages from You.
17.3. In addition, We may terminate all or any part of the Contract in the event Tokyo 2020 directs Us to terminate the Contract. In the event We terminate the Contract in accordance with this clause 17.3, You will be entitled to a full refund of the purchase price in respect of any cancelled Ticket.
- OUR USE OF YOUR INFORMATION
18.1. We collect information about You and Your Attendees when You purchase a Ticket.
18.3. We are contractually obliged to pass on Your data to the BOA, TOKYO 2020 and the IOC for ticket management and reporting purposes. You (and You will procure all Attendees) must consent to Us using Your personal information in this way.
18.4. The data that We collect from You will be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for Us, or for one of our suppliers, or for TOKYO 2020. Such staff may be engaged in, among other things, the fulfilment of Your Ticket, the processing of your payment details and the provision of support services. By submitting Your and all Attendees personal data, You (and You will procure all Attendees) must agree to this transfer, storing or processing.
- GENERAL TERMS
19.1. In the event that any provision(s) of the Terms and Conditions be declared void, ineffective or unenforceable by any competent court, the remainder of these Terms will remain in effect as if such void, ineffective or unenforceable provision(s) had not been included.
19.2. We shall not be liable to You for any breach of our obligations under the Contract if such breach is due to an act, event, omission or accident beyond our reasonable control, including without limitation, industrial or civil disputes, war, governmental action, riot, fire, flood, drought, other natural disaster or act of God, riot, crowd disorder, civil commotion, military operations, explosion, structural damage, terrorism (including the threat of terrorism and epidemics), legislation, regulation, ruling or omission, shortage of power supplies, strike, lock-out, boycotts or other industrial action of the affected party of their sub-contractors, delay, interruption, rescheduling, postponement or cancellation of the Session or cancellation of the Tokyo 2020 Olympic Games in whole or in part.
19.3. The Contract is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, anyone else except TOKYO 2020 and the BOA.
19.4. You shall not, without our prior written consent assign, transfer, charge, sub-contract or deal in any other manner with all or any of its rights or obligations under the Contract. We may at any time assign, transfer, charge, sub-contract or deal in any other manner with all or any of its rights or obligations under the Contract.
19.5. Any waiver by Us of any right We have under these Terms and Conditions is only effective if We confirm it to You in writing.
19.6. In the event of any conflict between these Team GB Live Ticket Purchase Policy and the Tokyo 2020 Ticket Terms and Conditions, the Tokyo 2020 Ticket Terms and Conditions shall prevail.
19.7. This Contract is governed by English Law and subject to the jurisdiction of the courts of England & Wales.
